Contractual Loss & Expense Claims or Schedules , continues to represent are mainstay of our business.

Usually if Contractors/Subcontractors don’t have proper Construction Valuations done during the works and instead have only progress claims (on-account payments) to go off then the expertise to do this will require knowledge of legal principles, financial techniques and presentation methods to best convey the events which cause for the claim as well as the resulting financial effects. Complicated concepts must be put into simple terminology for those that need to understand the claim in order to agree to it such as ‘Measles Plots’ or ‘Cause & Effect Matrix/Schedules’.

The rise of the “global” claim method as a means for presenting a claim whilst legally permissible, does unfortunately require having to wait until the end of the job to do this. This is a legal ‘damages’ type of claim and though it may be the simplest way to submit a claim, it will undoubtedly result in cash-flow issues during the project. The better way is to prepare a prospective Loss & Expense soon after the event that will cause the claim. See more about this on a website at “Opportunity & Forensic Audits”

This is exactly what our Construction Valuers do for Contractors who know that “something is wrong” during the job but need help to quantify this and present this properly. May be the job is not on track to hit the completion targets required under the contract or perhaps the job is running over budget, either way both will normally result in a Loss & Expense claim, unless it is simply all down to the poor management by the Contractor. From our experience we see that this is usually not the case.

Our team investigate what has resulted from the actions of others (not under the control of the Contractor) and quantifies the Loss & Expense. We can write the claim, gather the documentary evidence in support of it and also prepare the financial schedules to quantify the claim. Alternatively we can provide a part of the claim document if that’s all that is required such as just the Loss & Expense Schedule
